Judge Denies Motion to Dismiss

In June of 2010, the District Court for the Middle District of Pennsylvania denied the defendants’ motion to dismiss Ms. Reynolds’ claims under the ADA and Rehabilitation Act for injunctive relief and damages. The defendants had argued that various laws gave them immunity from this type of lawsuit, and that the reasoning behind their prejudice against people undergoing methadone treatment provides an acceptable legal basis for revoking Ms. Reynolds’ nursing license.

The decision granted the state’s motion to dismiss claims against individual members of the Board of Nursing, preventing them from being held personally liable for the Board’s discrimination.
