On July 13, 2012, we filed a motion for class certification asking for the plaintiffs to consist not only of the individual families already involved, but “all children with autism in the School District of Philadelphia in grades kindergarten through eight (‘K-8’) who have been illegally transferred, are in the process of being transferred, or are at risk of being illegally transferred, as a result of the District’s Automatic Autism Transfer Policy, the parents and guardians of those children, and future members of the class.” The School District submitted a memorandum in protest of this motion.
